Terms of Service

These Terms of Service ("Terms") govern your use of General Mountaineering (the "Service"), available at generalmountaineering.com. By using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. What the Service Is

General Mountaineering helps climbers plan mountain trips by providing route-specific gear information and tools to build, save, and share personal gear checklists. All content on the Service is general information — it is not professional mountaineering, safety, or medical advice.

2. Accounts

Some features require an account. Sign-in is handled by Replit, our identity provider; we receive basic profile information when you sign in. You are responsible for activity that happens under your account. You must be at least 13 years old to create an account. We may suspend or close accounts that violate these Terms.

3. Your Content

You keep ownership of the content you create on the Service — your gear lists, custom gear items, locker entries, and feedback ("Your Content"). So that the Service can function, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content for the purpose of operating, improving, and providing the Service, including showing shared lists to people you share them with. This license ends when Your Content is deleted from the Service, except for copies others have made of lists you shared while they were public.

You are responsible for Your Content. Do not post content that is unlawful, that infringes someone else's rights, or that you do not have the right to share.

4. Shared Lists

When you share a gear list, the Service creates a snapshot with an unlisted web address. Anyone who has that link can view the snapshot and copy it into their own account — treat share links as public. Shared snapshots are frozen at the moment of sharing; later edits to your own list do not change them. You can stop sharing a snapshot by deleting it, but copies that other users already made remain theirs.

5. Acceptable Use

When using the Service, you agree not to:

Break the law or encourage others to do so
Post content that is abusive, deceptive, infringing, or harmful
Attempt to access other users' accounts or non-public parts of the Service
Interfere with the operation of the Service, including by scraping at scale, probing for vulnerabilities, or overloading our infrastructure
Misrepresent gear or route information in lists intended for others in a way that could endanger them

6. Our Content

The Service's route information, gear catalog, design, and software are owned by General Mountaineering or its licensors and are protected by intellectual-property laws. We grant you a personal, non-commercial license to use them through the Service. Route and gear information is compiled from public sources; source attributions shown on route pages belong to their respective owners.

7. Content Moderation and Termination

We may remove content or suspend or terminate accounts that we reasonably believe violate these Terms or put other users at risk. You may stop using the Service at any time and may request deletion of your account and data via our contact page.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that gear information is complete, current, or appropriate for your climb, or that the Service will be uninterrupted or error-free.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENERAL MOUNTAINEERING AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, SAFETY INCIDENT, INJURY, OR DEATH ARISING FROM YOUR USE OF THE SERVICE OR YOUR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO FIFTY U.S. DOLLARS (US $50) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless General Mountaineering and its operators from claims, damages, and expenses (including reasonable attorneys' fees) arising from Your Content or your violation of these Terms.

11. Governing Law and Disputes

Please read this section carefully — it affects your legal rights.

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles.

If you have a dispute with us, contact us first through the contact page; most concerns can be resolved informally within 30 days. If we cannot resolve a dispute informally, you and General Mountaineering agree that the dispute will be resolved by binding, individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring an individual claim in small-claims court in New York or seek injunctive relief for intellectual-property misuse. The Federal Arbitration Act governs this arbitration clause.

Class-action waiver: disputes must be brought on an individual basis only — not as a plaintiff or class member in any class, consolidated, or representative proceeding.

Opt-out: you may reject this arbitration agreement by contacting us through the contact page within 30 days of first accepting these Terms, stating that you opt out of arbitration.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date above and, for material changes, post a notice on the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.
